Voter Rights

YOUR RIGHTS AS A VOTER

This information was originally issued by the Brazos Voters Protection Program, a joint venture of the local NAACP, ACLU Chapter, and the League of Women Voters.

If you are a registered voter, you have the right—

  • To vote at any early voting location in the county in which you live.
    (Texas Election Code, Section 85.055)
  • To vote even if you do not have your voter registration card. You can do this by showing other identification such as your driver's license, other photo ID, birth certificate, citizenship papers, passport, pre-printed checks, official government mail, or two other forms of identification (including utility bills). (Texas Election Code, Section 3.0101)
  • To vote in the precinct where you live even if your voter registration has your old address and you are not on the list of registered voters in that precinct. The poll workers should have a form (affidavit) you can fill out stating you are a resident of the precinct or have submitted a change of address to your new precinct. (Texas Election Code, Section 63.007)
  • To vote if a poll worker signs an affidavit stating he/she recognizes you. You must show proof of identification such as your driver's license, other photo ID. (Texas Election Code, Section 63,008(2))
  • To vote for any candidate or issue, including straight ticket for one political party, if you so choose. (Texas Election Code, Section 124.001)

As a registered voter, you also have the right—

  • To cast your vote in secret and free from intimidation. (Texas Election Code, Section 276.001)
  • To cast a provisional ballot if your right to vote is questioned. (Texas Election Code, Section 63.010)
  • To bring written materials into the voting booth to assist you as you cast a ballot. (Texas Election Code, Section 61.011)
  • To make any changes in how you voted before you turn in your ballot. If you are voting on a paper ballot the poll worker can provide you with up to two additional ballots if you make a mistake while marking your original ballot. If you are voting on a computer or electronic voting machine the poll worker can explain how to change your vote if you make a mistake. (Texas Election Code, Section 64.007)
  • To written instructions about how to cast your ballot. (Texas Election Code, Section 124.063)

As a registered voter, you can—

  • Request additional instructions about proper procedure when casting your ballot. (Texas Election Code, Section 61.009)
  • Ask for assistance while casting your ballot if you cannot write, see the ballot, or understand the language in which it is written. (Texas Election Code, Section 61.034)
  • Select another registered voter to assist you with interpreting as you vote. (Texas Election Code, Section 61.032)
  • Report voting rights abuse to the Secretary of State or your local election official. (Texas Election Code, Section 31.0055)

Si es un elector registrado, usted tiene el derecho de—

  • Votar si uno de los encargados de las casetas de elecciones firma una declaración jurada donde diga que lo reconoce. Usted debe mostrar una prueba de identificación tal como la licencia de manejo u otra identificación con fotografía. (Código de Elección de Texas, Sección 63.008(2))

Como elector registrado, usted también tiene el derecho de—

  • Emitir su voto secreto y sin ninguna intimidación. (Código de Elección de Texas, Sección 276.001)
  • Emitir una boleta provisional si su derecho al voto es puesto en duda. (Código de Elección de Texas, Sección 63.010)
  • Traer documentos o material escrito a las casetas de elecciones para ayudarle a emitir su voto. (Código de Elección de Texas, Sección 61.011)
  • Hacer cualquier cambio a su voto antes de entregar la boleta. Si emite su voto en una boleta de papel, el encargado de las casetas de elecciones le puede proveer dos boletas adicionales en caso de que cometa errores en la boleta original. Si emite su voto por computadora o cualquier otro sistema de voto electrónico, el encargado de las casetas de elecciones le puede explicar como hacer cambios en caso de que cometa un error. Como elector registrado, usted puede—

  • Solicitar más instrucción acerca del procedimiento apropiado para emitir su voto. (Código de Elección de Texas, Sección 61.009)
  • Pedir ayuda mientras emite su voto si usted no puede escribir, ver la boleta, o entender el idioma en el que esta escrito. (Código de Elección de Texas, Sección 61.034)
  • Seleccionar a otro elector registrado para que le ayude a interpretar o traducir al mismo tiempo que emite su voto. (Código de Elección de Texas, Sección 61.032)
  • Reportar cualquier abuso de sus derechos de elector a la Secretaría de Estado o al oficial encargado de las elecciones locales. (Código de Elección de Texas, Sección 31.0055)
